For minor breaches of the scheme rules the caseworker assigned can issue a private reprimand.

 

All other sanctions must be approved by the scheme Standards Board, and could include a public reprimand, suspension or removal from the scheme.

 

In reaching a disciplinary decision, the scheme Standards Board will take account of a number of factors in deciding the disciplinary sanction that should apply:

 

  • The regularity of breach
  • Severity of breach
  • Steps taken by the landlord to remedy the breach with the tenant
  • Changes made to procedures in light of the breach
  • Other disciplinary sanctions applied on the landlord in the past
  • Relevant precedent
